When you visit our website we will process your personal details. You will find information about scope and purpose of this processing in the following sections.

For safety reasons and for the protection of the transfer of personal details and other confidential content (e.g. orders or requests to the person in charge) our websites use SSL and TSL encryption. You can recognize an encrypted connection by the string “https//” and the lock symbol in your browser line.

These data protection regulations make equal reference in both men and women. For a better readability only the masculine form will be used.

II. General information about data processing

1. Scope of personal data processing
In principle we process our user’s personal data only to the extent necessary to ensure the provision of a functioning website as well as our content and services. The processing of personal data is only carried out with the user’s consent. Exceptions will be made only in such cases where prior obtaining consent is not possible due to factual reasons and data processing is permitted by legal regulations.

2. Legal basis for processing personal data

Insofar as we obtain consent for the processing of personal data from the person concerned Art. 6, Par. 1 lit. a DSGVO serves as legal basis.

For processing personal data which are necessary for the fulfilment of a contract of which the person concerned is a contractual party Art. 6, Par. 1 lit. b DSGVO serves as legal basis. This refers also to processing operations which are necessary for the execution of pre-contractual measures.

Insofar processing personal data is necessary for the fulfilment of a legal obligation to which our company is subject Art. 6, Par. 1 lit. c DSGVO serves as legal basis.

If processing is necessary for protection of a legitimate interest of our company or a third person and if the interests, fundamental rights and freedoms of the person concerned do not outweigh the interest mentioned first, Art. 6, Par. 1 lit. f DSGVO serves as legal basis.

3. Data deletion and storage periods

The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage is no longer pursued. A storage can also take place if this was intended by the European or national legislator in relevant union legislation regulations or other provisions to which the responsible body is subject to. Deletion or blocking of data will take place also in the event that a storage period required by the above mentioned provisions ends, unless there is a necessity for further data storage for the conclusion or performance of a contract.

 

III. Data processing in particular

1. Data processing when visiting our website

Each time you visit our website – irrespective of whether you register or submit information to us otherwise – your browser automatically submits data and information from your computer to our website server, so-called server log files. The following data will be collected:

  • IP-address of requesting computer
  • Information about browser type and version used
  • Operating system of requesting computer
  • Internet service provider of requesting computer
  • Date and hour of access
  • Websites from which our Internet pages are accessed (referrer URL)
  • Websites which are accessed through our site

Aforesaid data will be processed by us for the purpose of ensuring a seamless connection set-up of the website and comfortable use of our websites, evaluation of system security and stability and for administrative purposes.

Purpose of the processing is the provision of your website. Legal basis for processing is Art. 6, Par. 1 lit. f DSGVO. It is our legitimate interest to ensure the functioning and optimizing of our websites as well as to offer information about our scope of services.

2. Cookies

In order to be able to design your visit to our website more user friendly and to enable us to analyse the usage of our website we use so-called cookies. Cookies are small text files containing small amounts of information which are downloaded to your terminal device (PC, laptop, tablet, smartphone etc.) by your browser.  Cookies contain a characteristic string that enables a clear identification of the browser when entering the website again. If you visit the respective website again cookies will enable the recognition of your terminal device.

Please see in the following the kinds of cookies we use:

  • Cookies that will be deleted automatically from your hard disc when closing the browser (transient cookies, in particular so-called session cookies).

As far as cookies will be used to aim at the conclusion or execution of the contract Art. 6, Par. 1 lit. b DSGVO serves as legal basis. If cookies are used to ensure our justified interests in a convenient functionality as well as analysis and improvement of our website, Art. 6, Par. 1 S lit. f DSGVO serves as legal basis. Our websites also contain content and services from other providers (Google) who for their part may use cookies and components as well. Here, we refer to the corresponding explanations.

Cookies will be stored on your computer and will be transmitted from there to our websites. Thus, you remain in full control of the usage of cookies. By changing your browser settings you can de-activate or limit the transmission of cookies. Cookies which have already been stored can be deleted at any time, this can be done automated. If cookies for our website are de-activated it might be the case that not all of the website’s functions can be used entirely.

3. Long-term parkers form

On our websites we offer users the opportunity to conclude a rental contract for a parking place under specification of personal data. If you fill out the long-term parkers form we will process your personal data as follows: title, gender, first and last name, phone contact, postal address, email address, car license plate number, bank account details and location of the parking place rented. Purpose of the data processing is the enabling of the conclusion and execution of the rental contract. Here, Art. 6, Par. 1 lit. b DSGVO serves as legal basis. Data will be stored for the duration of the contract and furthermore for a period of 10 years in order to comply with legal time limits. Data will be processed for the transmission from our hosting provider to us and buffered there for 7 days.

4. Contact opportunities through our websites

Due to legal provisions our websites contain information which will enable fast electronic contact to our company and direct communication with us. For this purpose, we will hold ready our postal address phone and fax contact as well as an email address. If you contact us through email the personal data transmitted by you will be processed automated.

The purpose of this processing is the provision of a means of communication with you. Art. 6, Par. 1 lit. b DSGVO serves as legal basis for the processing. Our justified interest lies in securing the legal requirements and offering a direct means of communication with us.

5. Job applications

If you send us your job application via email we will process your personal details that you transmitted to us like your name, your postal address and information from your CV.

If you decide on using our application tool that is provided on our websites for your application we will process the personal data that you enter in the context of using our application tool.

Such data contain information about your person provided by you like your name, your gender, your marital status and your intended starting time. In addition, we will process your postal address, phone number and email address as contact information.

The purpose of processing is the execution of the application process, the legal basis is Art. 6, Par. 1 lit. b DSGVO.

If you send us your application via an application portal your data will be processed for the transmission of the data from the application portal to us. At this point we refer to the privacy declaration of the portal that you used. Data transmitted to us will be stored for the duration of the application process and at the finalization of a work contract to comply with legal time lines.

6. Tools

Google Analytics

This website uses Google Analytics, a web analysis service operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google) in order to analyse and continuously improve the use of our website and to ensure a needs-based design. With help of the statistics obtained we are able to improve our services and design them to be more interesting for you as users. The legal basis is Art. 6, Par. 1 lit. f DSGVO, with our legitimate interest resulting from the aforementioned purposes.

Google Analytics uses so-called “cookies” (see also abovementioned cookies in this privacy declaration). These are text files that are stored on your terminal device (PC, laptop, tablet, smartphone ec.) and that allow an analysis of your use of the website. The information generated by cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. This information is used to evaluate the use of the website, to generate reports about website activities and to provide services connected to Internet use with the purpose of market research and ensuring a needs-based design of these websites.

In case of activation of the IP anonymization feature on this website your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area. We would like to point out that this website uses Google Analytics with the extension “anonymizedIP” therefore IP addresses will only be processed in shortened versions, thus a personalized identifiability is impossible. Google Maps

This website uses the Google Maps API map service operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (Google). Google maps is a web service for the presentation of interactive maps visual to present geographic information visually. By using Google maps the respective locations of our parking facilities will be displayed to you and a possible route will be shown to you.

If you access the subpages where Google Maps is integrated information about the use of this website, including your IP address, is transmitted to and stored on a server belonging to Google in the USA. This will happen irrespective of whether Google provides a user account to which you are logged in or a user account does not exist. If you are logged in into Google your data will be assigned to your account. If you do not wish an allocation with your profile at Google you are asked to log out from Google. Google will store your data (even for users who are not logged in) as user profiles and evaluates them. Such an evaluation will take place in particular according to Art. 6, Par. 1 lit. f DSGVO on the basis of Google’s justified interest in insertion of personalized advertisements, market research and/or needs-based design of it’s website. Google LLC, located in the US, is certified for the US-European data protection agreement “Privacy Shield” which guarantees the compliance with the data protection level effective in the EU.

If you do not agree to future transmission of your data to Google when using Google Maps it is possible to simply deactivate the Google Maps service by deactivating JavaScript in your browser. However, in this case you will be unable to use Google Maps and the map view on this website.

IV.Order processing and data transmission aside from that

We transmit data to our sub-contractors who have been assigned by our company with the execution of services.

First of all, this is the company Source Tree GmbH, Düsselstr. 30, 40219 Düsseldorf who is responsible for the technical support of our website. Source Tree GmbH itself has concluded an order processing agreement with Amazon Web Services Inc. (AWS) to be able to receive hosting services from AWS. Our websites are hosted by Amazon Web Services Inc., therefore your data will transmitted to and processed by AWS on our behalf. These data will be processed exclusively on AWS servers in Germany and stored pseudonymised for 7 days.

Moreover, Source Tree GmbH itself has concluded an order processing agreement with Google LLC to be able to use analysing tools offered by Google. If you conclude a permanent parking contract with us we will transmit your data to the respective providers of parking technology to provide you with the leased parking spot and to allow you to enter to and exit from your leased parking spot through parking technology. For the parking garage Esprit Arena/P7 it is Design Verkehrsleittechnik GmbH, Faluner Weg 3, 24109 Kiel, for parking place Messe P2 Skidata Deutschland GmbH, Sonnenring 14, 84032 Altdorf and for all others Scheidt & Bachmann GmbH, Breite Straße 132, 41238 Mönchengladbach.

These service providers were selected and assigned with utmost care and are bound by our instructions and are reviewed at regular intervals. In this respect, Art. 28 DS-GVO serves as our legal basis so we can guarantee that your personal data are adequately protected and will only be processed for purposes which were agreed between us and our service providers.

Moreover, we will only transmit your personal data to third parties in the following cases:

  • if we received your explicit consent according to Art. 6 Par. 1 S. 1 lit. a DS-GVO,
  • if there is a legal obligation for the transmission according to Art. 6 Par. 1 S. 1 lit. c DS-GVO, for example in relation to criminal prosecution or
  • for the establishment or defense of legal claims or the exercise of claims in case it cannot be assumed that the transmission conflicts with a major legitimate interest of the party concerned.

 

V. Rights of persons affected

You have the following rights concerning your personal information held by us:

  • The right to disclosure (Art. 15 DS-GVO) about your data processed by us;
  • The right to rectification (Art. 16 DS-GVO) or completion of your data processed by us;
  • The right to deletion (Art. 17 DS-GVO) of your data processed by us insofar the processing is not exceptionally necessary according to Art. 17 Par. 3 DS-GVO;
  • The right to restriction of processing (Art. 18 DS-GVO);
  • The right to information (Art. 19 DS-GVO);
  • The right to data portability (Art. 20 DS-GVO);
  • The right to object or to withdraw consent (Art. 7 Abs. 3 DS-GVO).

In addition you have the right to lodge a complaint with a data protection supervising authority if you are of the opinion that our processing of your personal data is unlawful. Objections against processing of your data
Insofar as our processing of your personal data is based on the balancing of interests you can enter an objection to processing. This is the case if the processing in particular is not necessary for the execution of a contract with you. This we will illustrate through a corresponding description of the functions. If you execute such an objection we will ask you to lay out the reasons why we shall not process your personal data in the usual way. In case of your reasonable objection we will examine the situation and will either stop or adjust data processing or will point out to you our compelling legitimate reasons for continuing the processing.
